Recently the State Comptrollers office has been sending letters to anybody who provides hunting and/or fishing guide services in an effort to collect Hotel and Occupancy taxes on all hunts from June 2004 through June 2008.  What this means is that all hunting ranches that offer overnight accommodations for their hunters as well as food services must pay a hotel tax to the state of Texas on the lodging portion and a sales tax on all food served during a package hunt.

The letters sent out set a deadline of July 28 to pay any back taxes or severe penalty will be incurred.  According to the comptrollers office taxes will have to be paid for the services whether you actually charge for the service or not.  If lodging was included in a package hunt, but was not itemized on the receipt, a tax would have to be paid on the total amount.  If the lodging/meals were listed separately, then a tax would have to be paid only on them.  There are also side effects that could result in this tax situation such as increased property tax and possibly harming an Agriculture/wildlife Exempt status.

The Exotic Wildlife Association, Texas Wildlife Association, Texas Deer Association and the Texas Farm Bureau have been working to resolve this matter.

If you want to voice your opposition to this interpretation of the tax rule, please contact your legislators and the Texas Comptrollers office at 1-800-688-6829 extension 59885.

This situation is very serious and could be detrimental to the commercial hunting ranch industry in Texas.

Ridiculous...does this mean if they serve food they have to have a restaurant license too?

Good ol uncle Sam never misses an opportunity to make a buck. It does now matter that the reason is "STUPID OR NOT". The dummer the reason, the more they will push it. We as hunters and the people who are trying to make a living will ALLWAYS be the target of these money hungry monkeys.

One other thing that I just thought of. Question: if I invite Mother over for the weekend and cook for her, how much do I charge her for the lodging and food service taxes?

I've had about all I can take. I think I'll run for governor. I don't like the crowd in Texas politics anyway:

Gun control is KILLING the bad guys when they are being chased or in the process of commiting a crime.

Property taxes are unconstitutional. Supreme Court ruled we can't tax our RIGHTS. See the Constitution where WE have the right to own property!

We have freedom of religion. We don't have freedom FROM religion.

We don't have a right to not be offended! So shut-up about hurting your feelings.

State will get its money from sales tax not to exceed 5% EVER and taxing property sales at 9%. It can be paid in one lump sum based on sale price or paid-out over time at a rate of 7%.

Texas will defend and regulate its border and keep the money from going to the FEDS to do it.

Gasoline will be refined HERE from COAL.

Diesel will have sulfur in it so it does not cost $5/ gallon.

Murderers, rapists, cattle, horse, and firearm thieves, and child molesters will swing at the capitol's steps for all to see.

All will be educated in Texas history and the Constitution and in ENGLISH!

Stupidity is a state felony.

Then we won't have these stupid people trying to get more money from us working people.

Who can I count on for a vote?

GO CLIMB A TREE, TIM

I got your back! Might have to run for Lt. Governor on that note. I am tired of hearing people standing trial for doing the right thing i.e. the Boder patrol agents that shoot the drug dealer.

Tim,

Your got my vote...if you pay for your ranch/house/whatever and the government has the 'right' to take it back from you if you don't pay taxes, then who's property is it really?

What about taxes?  We never even had a Federal Income Tax until 1914 or so!

And judicial 'activism'?  The Framers thought so much of the Supreme Court that they met in the capital building's BASEMENT once a year (if I remember correctly).  Wish that were true now - they should impeach 5 of the bunch we have.  Then try them for treason.
