Texas -

The Texas Wildlife Association strongly supports the passage of Proposition 11 on the November 3 ballot to help protect homeowners and private property owners from abusive eminent domain.

Proposition 11 will add wording to the Texas Constitution that:

  • Requires that any condemned home or private property must be for legitimate public use (in other words, not for private economic development or private gain)
  • Prevents mass condemnation of homes and private properties
  • Severely limits the legislature's ability to award the power of eminent domain t new entities
  • Leaves unaffected the existing state constitutional guarantee requiring fair compensation when eminent domain is for legitimate public use

A summary of Proposition 11 and the other 10 constitutional amendments is also available.
